Immigrating to a stable country like Canada brings many advantages like a robust education system, top-notch healthcare, job security, a thriving economy, and much more. Besides these, Canada welcomes immigrants with open arms, embraces multiculturism, and encourages all its citizens to honour their cultures and ethnicities. People from all over the world immigrate to Canada every year; some do it to fulfill certain needs, while others move here to enjoy a high quality of life, making this country a hot cake for immigration.

Canada is planning on welcoming nearly a million new immigrants—411,000 in 2022 and 421,000 in 2023, to be exact—as per its 2021–2023 Immigration Levels Plan. These levels are higher than the country has ever targeted before.

If you’re also considering immigrating to Canada, you’re in the right place. We will discuss different ways you immigrate to Canada, and you can also contact our immigration lawyers in Toronto to kick-start your process.

How to Immigrate to Canada

Immigration lawyer in TorontoExpress Entry Program

Although the past years have been challenging for the express entry candidates due to the COVID-19 pandemic, this program has gained traction this year once things got back to normal. In fact, the challenges paved the way for Canada’s immigration minister, Sean Fraser, to implement a more efficient immigration system.

The express entry program is one of the most preferred and quickest ways of immigrating to Canada. It can also help you become a PNP nominee.

There are three immigration programs offered through Express Entry.

1. Federal Skilled Worker Program (FSWP)

This program is for individuals aged 18–44 with experience in a skilled worker job in a foreign country. Besides work, there are certain factors, like education, language, etc., that you need to meet to be eligible for this program. It’s a points-based system where the more points you get, the more chances of qualifying.

2. Federal Skilled Trades Program (FSTP)

It’s for those skilled workers with at least two years of work experience in a skilled trade. Although there’s no education requirement for this program, you can improve your chances of selection by getting a degree.

3. Canadian Experience Class (CEC)

The Canadian Experience Class program is for skilled workers with at least three years of Canadian work experience.

Provincial Nominee Programs (PNP)

Immigrating through the PNPs is another popular way to immigrate to Canada. Every province has developed its own immigration programs with specific requirements that help speed up the process. It’s important to note that once you arrive in Canada using the PNP route, you’ll have to reside in the respective Province. For example, if you applied through Ontario Immigrant Nominee Program (OINP), you’ll have to reside in Ontario after immigration.

To qualify for the Provincial Nominee Programs, applicants need to meet the eligibility criteria of the respective program and province. Each PNP has a different application processing time. Once you receive a nomination, you’ll need to apply to the federal government for permanent residence. Contact our Toronto immigration lawyers for more details on Provincial Nominee Programs.

Business Immigration

This option is well-suited to individuals with experience owning or managing a business. You can immigrate through a provincial or federal business immigration program.

The government offers several immigration programs for those who want to start up a business in Canada or plan to be self-employed. Each province also offers several Provincial Nominee Programs to support innovation and economic growth in the country.

Business immigration requires investment in the company/business you’re planning to start in Canada. The investment amount depends on the program you’re applying through. For example, several PNPs offer regional entrepreneurship programs that require lower investment if you intend to start a business in a less populated area.

Family Sponsorship

If you have any family member or qualifying relative that’s a citizen or permanent resident of Canada, they can sponsor you to immigrate to Canada. There are multiple immigration programs for Family Sponsorship, and each year Canada welcomes thousands of new permanent residents through them. Your sponsor must be 18 years old or older to qualify for this program. You must also ensure that your sponsor has a qualifying relationship with you before applying for immigration.

The processing time for family sponsorship depends on your relationship with your sponsor. For example, if your spouse is sponsoring you, the process will take about 12 months. Learn more about spousal sponsorship in Toronto or contact our family lawyers.

Those individuals who receive a job offer from a Canadian employer can immigrate to Canada with LMIA Visa. LMIA or Labour Market Impact Assessment is a document Canadian employers receive before hiring foreign workers. It involves a labour market verification process that all foreign workers must undergo.

In this process, Employment and Social Development Canada (ESDC) evaluates the employment offer to make sure that workers’ employment will not negatively impact the Canadian labour market.

You cannot apply for an LMIA; your Canadian employer has to. They also have to submit different details about the job, including the number of Canadians who applied for the position. Once the employer receives a positive LMIA, the worker will need to apply for a work permit within six months of issuance of the LMIA. After getting a work permit, you can immigrate to Canada and become a permanent resident.
