At Nanda, our personal injury lawyer in Brampton, Mississauga, Toronto & Southern Ontario covers traumatic events including:

Motor Vehicle Accidents

When one sustains an injury in a motor vehicle accident there are two potential sources for recovery. The first source that your lawyer will automatically look to are your Statutory Accident Benefits (SAB’s). Anyone injured in a motor vehicle accident is entitled to SAB’s regardless of fault. The second source for recovery is through a tort claim or by suing the other parties who may be at fault or have contributed to you sustaining your injuries.

  • Statutory Accident Benefits – The law in Ontario requires all owners of vehicle to have auto insurance and all auto insurance policies provide for SAB’s. Even if you were not the driver and were only a passenger, or a pedestrian and do not even have your own policy of auto insurance, if you were injured in a car accident you are entitled to claim SAB’s from the insurance policy in place for the vehicle. All injured persons in a car accident are entitled to SAB’s regardless of who is at fault in the accident which is why they are commonly referred to as “no fault benefits”. SAB’s provide benefits, within limits, for the following:
    • Caregiver Benefits / Income Replacement Advantages / Non-Earner Benefits
    • Rehabilitation and Medical Benefits (for physiotherapy + miscellaneous treatments)
    • Attendant Care Benefits – So that you can pay for an Attendant
    • Housekeeping Benefits
    • Death and Funeral expenses
    • Travel and Relocation Expense
    • Purchase of Damaged Clothing and Apparel
  • Tort Claim – Unlike SAB’s, a tort claim is dependant up fault. With a tort claim you are seeking money compensation for your injuries and the losses sustained because of them. Even if another party is only 1% percent responsible for the accident that caused your injuries, you are entitled to seek that 1% of your losses from them. As the SAB’s may not completely cover all of the costs you face now or all of the future losses associated with your injuries, the tort claim allows you to claim what may not be covered. This is an especially important function of the tort claim as things such as a future loss of income can easily add up to large sums where the impact of the injury will be felt for years to come. It is through the tort claim you are able to seek out compensation for your pain and suffering. If family relationships have been affected by your injuries, depending on the circumstances, a tort claim may allow family members to be compensated for loss of your guidance and companionship due to the accident.

We have many years of experience in dealing with these types of claims and would be happy to provide you with a consultation so that you are aware of what your rights, obligations and entitlements are when injured in a car accident.

Slip & Fall Injuries

Also known as “Trip & Fall”, these injuries refer to injuries you can sustain if you fall on someone else’s property due to the condition of the property. Boating Accidents

Waterways in Ontario are getting increasingly crowded. More jet skis, powerboats and yachts have led to an increase in the number of accidents on water. The reasons can be varied. Alcohol consumption and inexperience are a few of the the major causes. Fortunately, Ontario provides the boat victims the power to demand compensation from other boat owners or fleet operators. A legal expert will help you deal with boating accidents in a professional way.

Wrongful Death

The death of a loved one is a tragic event in one’s life. Naturally, it is difficult to accept what fate has done. However, the pain and trauma increase when that the death could have been prevented.

It is true that no amount of money will ever compensate for the loss of one’s loved ones. However, besides emotional loss, monetary loss is another huge blow the family has to deal with. The loss of an income that a family relied upon can be devastating. Various expenses including funeral expenses, child care, household bills and miscellaneous expenses related to the individual can be overwhelming to take care of. In many circumstances, even where there is life insurance to look to, a family will not be left with the financial resource to secure their future. Where another party may be responsible, to any degree for such a loss, you may be able to protect yourself and your family from the financial impact through a law suit. Call and speak to our lawyers and they can give you guidance on how to navigate through those types of difficult times.

Product Liability

It is normal to assume that when you purchase something and bring it home, it is safe to be used for whatever its intended purpose. If there is a defect in that product and it results in some sort of injury or loss you may be able to seek monetary compensation from whoever is responsible for that defect. The parties who may be held responsible for a defect can range from the manufacturer, the parts supplier, the shipper, the quality controller, anyone who did any work to maintain or modify the product, even the store that sold it to you might be held responsible. The losses that can result from a faulty product can go beyond pain and suffering alone, it can destroy your property and impact things like you income. Call us for a consultation and we can advise you with respect to what rights you have in your particular circumstances.

Dog Bites & Animal Attacks

The law in Ontario makes dog owners responsible for the actions of their dogs. Dog bites and attacks can leave more than just physical injuries, especially with children. Just as with other injuries, the psychological impacts of an injury are included in the damages you can seek compensation for. Call us for a consultation to find out more about your particular circumstances.

Disability Claims

It is unfortunate that in some situations the insurance company with whom people have a disability policy end up denying claims for either improper or insufficient reasons. When this happens and you feel you have a medical condition that rightly justifies a short term or long term disability claim you should pursue it. In many cases it can actually worsen you condition by returning to work when you are not medically cleared to do so. If you are in this circumstance we can help you to pursue you insurance company and obtain improperly denied benefits so that you have the support you need to enjoy a full recovery and return to work when you are safely capable of it.

Fees

At Nanda & Associate Lawyers we understand how financial demands can increase your stress. This is even truer in the event your injury has left you unable to work. In order to avoid the stress of legal fees we utilize a contingency fee arrangement. You do not have to pay for fees, disbursements or taxes unless we are able to successfully obtain a settlement or judgement for you. We are so confident in our ability to effectively represent you and obtain a monetary recovery that if you do not recover monies, we write off your complete account and you will owe us nothing.

The contingency fee itself is based upon a percentage of what you recover, this way you are assured of an easy, straight forward and predictable account. The actual percentage depends upon the type of case you have and its details. The contingency fee will be discussed at the outset of your case and will be explicitly set out in our Retainer Agreement with you so there will be no confusion or hidden fees that apply later on.
