Motor Vehicle Accidents
In Ontario, there can be two parts to every motor vehicle accident. There are claims against drivers, called Tort claims, and also claims against insurance companies called Accident Benefits claims.
Tort Claims
Tort claims are designed to compensate you and your loved ones for your pain and suffering, health care and attendant care expenses. There are also provisions regarding claims for various family members. There are conditions, however, about how and when you can make a tort claim.

If you have been in a motor vehicle accident, contact us immediately for a full explanation of your Tort claim.

Accident Benefits are available to anyone involved in a motor vehicle accident regardless of who caused the accident. These benefits are occasionally referred to as no-fault benefits.

SLIP & FALL / TRIP & FALL
“Slip & fall” or “Trip & fall” are generic terms used to describe an injury related to falling that occurs as a result being subjected to a dangerous and/or hazardous condition on someone else’s property.

Hazardous conditions exist due to a variety of reasons. Some examples include weather-related causes (the presence of ice, water or snow), strucutural changes (a change in flooring for instance), poor construction (uneven floor surfaces, broken sidewalks, uneven elevators) or other hazards such as poor lighting, etc.

If you have been hurt on someone else’s property due to dangerous conditions, they may be liable for your injuries and it is important to speak with a knowledable attorney as soon as possible.

We have represented countless individuals injured in department stores, restaurants, grocery stores, banks, hospitals and other buildings open to the public.

Boating Accidents
As our waterways become increasingly crowded with powerboats and jet skis, more individuals are becoming involved in accidents—some of which are very tragic. Statistics show that many of these accidents are a result of alcohol consumption, inexperience, or simple carelessness. In Ontario, victims of boating accidents can recover compensation from either the operator or the owner of the boat. Navigating the complex waters of boating accident regulations is complex, which is why expert legal assistance is essential.
Wrongful Death
The death of a loved one is an intensely painful and personal event. Coming to terms with such a loss is made more difficult when the death is unexpected and preventable.

No amount of money can fill the void left by the loved one lost. However, family members will face real challenges paying for funeral expenses, grief counseling, replacing the deceased’s help caring for children, managing the household and paying bills with less income.

Our system of law requires those responsible for the death to compensate family members for these and other losses. Family members are entitled to claim compensation from the person responsible for the death. This compensation is normally paid by the at-fault person’s insurer.

Time limits govern when you must notify the responsible parties that you intend to bring a claim and they govern when you must start your claim for compensation. These time limits can restrict your rights to recover your losses. Not everyone is entitled to claim compensation from the person who caused the accident. Each claim is different. Assessing the value of your claim and determining responsibility requires analysis by an experienced personal injury lawyer.

PRODUCT LIBILITY
We are all consumers of products. Products include everything from home electronics to food to clothing to vehicles. Unfortunately, not every product is safe, reliable or fit for the purpose for which it was purchased. Sometimes, a product causes a person injury, damage or financial loss. When that loss occurs the question is whether the manufacturer, seller or distributor of the product lived up to their responsibilities.

When a manufacturer places products into the public market they create a relationship of reliance with consumers concerning the dangers inherent in the use of the product. Every manufacturer of a product therefore owes the ultimate user of that product a duty of care. That duty of care requires that the manufacturer use all reasonable skill and care in the manufacture of the product. Similarly a seller or distributor has a duty to the public not to sell or distribute a product that it knows or ought to know is unsafe. If the seller, distributor or manufacturer breached the applicable standard of care and that breach caused or contributed to an injury then the seller, manufacturer or distributor will be legally responsible for any resulting losses. Compensation for those losses may include damages for pain, suffering and loss of enjoyment of life as well as future care costs and other economic losses

Paraplegic & Brain Injuries
As Lawyers representing a catastrophic personal injury case, it is our job to investigate the cause of the injury to determine and prove responsibility of the parties liable for events causing the accident.

Injury patients may be entitled to compensation to the extent that their injury was caused or contributed to by the negligent acts or omissions of others.

In some instances, such as in the case of a brain injury, which is not visible, there are special legal challenges in obtaining proper compensation for the victim. Your lawyer must be able to present sophisticated medical and psychological evidence to prove that the injury has occurred and how it affects the patient.

Be careful to find a firm that has adequate experience in serious injuries.

Dog Bites & Animal Attacks Injury Lawyers
In most cases of animal attacks, the fault isn’t with the animal; it’s with the animal’s owner.

Pet owners and keepers have a responsibility to make sure their animal is secure and in no way a danger to anyone else around them. Laws are in place because animals can’t control their unpredictable behaviour, but their owners can. When they fail to do so, innocent people can get hurt

Disability Claims Lawyers
People buy insurance to protect themselves from loss of income, rehabilitation expense, treatment expense and other losses resulting from injury, sickness and health problems.

Often one is faced with an insurer not wanting to honour the policy and deny payment on the grounds that the policy holder no longer falls within the terms of the policy or has recovered to such an extent that there is no longer a sustained loss. This is in spite of the fact that policy holders have paid for years for these benefits. Our firm has had many years of experience dealing with insurance companies in this regard and can advise you.

In situations like this, their manipulation of the law may make you feel hopeless and everything is working against you. What you need is a team that can turn the law back to your side, and will fight for what’s owed to you.
